Acceptance of the Terms of Use
These terms of use are entered into by and between You and Claim ("Company," "we," or "us"). The following terms and conditions, together with our Privacy Policy (collectively, "Terms of Use"), govern your access to and use of www.getclaim.app, the Claim mobile application (the "App"), and any content, functionality, and services offered thereon (collectively, the "Services"), whether as a guest or a registered user.
By using the Services or by clicking to accept or agree to the Terms of Use when this option is presented, you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not access or use the Services.
The Services are offered and available to users who are 18 years of age or older and reside in the United States or its territories. By using the Services, you represent and warrant that you meet these requirements.
Changes to the Terms of Use
We may revise and update these Terms of Use from time to time. We will provide notice of material changes through the App or via email. Your continued use of the Services following notice means you accept and agree to the changes.
Accessing the Services and Account Security
We reserve the right to withdraw or amend the Services in our sole discretion. We are not liable if any part of the Services is unavailable at any time. You are responsible for ensuring that all persons who access the Services through your device comply with these Terms of Use. Any user credentials provided to you are confidential and must not be shared. Notify us immediately at support@getclaim.app of any unauthorized access.
Intellectual Property Rights
The Services and their entire contents are owned by Claim, its licensors, or other providers and are protected by intellectual property laws. You may use the Services for personal, non-commercial use only. Unauthorized reproduction, distribution, or modification of any content is strictly prohibited.
Trademarks
The Claim name, logo, and related branding are trademarks of Claim. You may not use such marks without our prior written permission.
Prohibited Uses
You may use the Services only for lawful purposes. You agree not to:
Violate any applicable law.
Exploit or harm minors.
Submit false or misleading information.
Use the Services for spamming, impersonation, fraud, or any illegal activity.
Interfere with or damage the Services.
User Submissions
You may submit information through the Services to file class action claims. All submissions must comply with these Terms and our Content Standards. By submitting any content, you grant us a license to use it for purposes related to processing your claims. You also authorize Claim to use your provided information solely for the purpose of preparing and submitting class action claims that you have reviewed and approved. This authorization does not create an attorney-client relationship or any fiduciary duty.
Monitoring and Enforcement
We reserve the right to:
Remove or refuse any content for any reason.
Disclose your identity to comply with the law.
Suspend or terminate your access for violations.
Content Standards
Submissions must:
Not infringe on third-party rights.
Be lawful and not misleading.
Not promote illegal or harmful activity.
Not impersonate or misrepresent identity.
Copyright or Trademark Infringement Complaints
To report IP concerns, email support@getclaim.app with a detailed notice, including proof of ownership and a description of the infringing content.
Information About You and Your Visits to the App
We collect and use your information according to our Privacy Policy. By using the Services, you consent to this use.
Class Action Claims Terms
Claim is not affiliated with class action administrators, law firms, or courts. You do not need Claim to file a claim and can do so independently. Claim simplifies the filing process but is not responsible for the outcome, timeline, or compensation of your claims.
Claim Is Not a Law Firm
Claim does not provide legal advice. Decisions about participation in class actions are legal matters, and you should consult an attorney if you need legal guidance.
Fee for Service
Claim charges a service fee of $4.99/week, billed annually or weekly. This fee is non-refundable. For users residing in California, subscription terms and cancellation options are presented in compliance with Cal. Bus. & Prof. Code §§ 17600 et seq.
User Cooperation
You agree to provide complete and accurate information and respond promptly to requests related to your claims. You are solely responsible for verifying your eligibility and ensuring that all information submitted is truthful. Claim will cooperate with law enforcement in any cases of suspected fraud.
Third Parties and Estimates
Claim is not liable for delays or failures by third parties (e.g., administrators). Payment estimates and timelines are not guarantees.
Taxes
You are solely responsible for any taxes due on any payments you receive from claims.
No Legal Relationship
These Terms do not create an agency, partnership, or employment relationship between you and Claim.
Links to Third Parties
Links provided in the App are for your convenience only. We are not responsible for third-party content.
Geographic Restrictions
Claim is based in California and intended for U.S. users only. Use outside the U.S. is at your own risk.
Disclaimer of Warranties
The Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, accuracy, or completeness.
Limitation on Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
Indemnification
You agree to indemnify and hold Claim harmless from any losses arising from your use of the Services or violation of these Terms.
Governing Law
These Terms are governed by California law. Any dispute shall be resolved in the courts located in Austin, Texas, unless subject to binding arbitration as described below.
Binding Arbitration
Most disputes can be resolved informally. If not, we agree to resolve disputes through individual arbitration under AAA rules. Class actions and jury trials are waived. Arbitration hearings will be in Austin, TX. You may opt out of this clause within 30 days of acceptance by emailing support@getclaim.app. If this provision is deemed unenforceable, the remainder of this arbitration agreement will remain in effect.
Limitation on Time to File Claims
You must bring any claims within one year from the date they arise.
Waiver and Severability
Our failure to enforce a provision does not waive it. If any part of these Terms is invalid, the rest remains in effect.
Force Majeure
We are not liable for delays or failures caused by events beyond our control (e.g., natural disasters, war, pandemics).
Assignment
You may not assign these Terms without our consent. We may assign them freely.
Survival
Provisions that logically should survive termination do so.
Entire Agreement
These Terms and our Privacy Policy are the entire agreement between you and Claim.
